台湾地区“物权法”新修正之评述

台湾地区“立法院”于2010年1月5日修正了“民法”用益物权和占有章。用益物权和占有章所修正的内容体现了法律现代化的要求。在用益物权章，修订了地上权的规定，鉴于土地立体利用之需要，增订区分地上权；废除永佃权的规定，增订农育权的规定；地役权章的修正非常大，鉴于需役及供役之客体已经从土地扩张至其它不动产，为符合这一变化，将“地役权”之章名修正为“不动产役权”；此外，关于占有的修正，增订了占有权利推定之例外规定；修正动产善意取得制度等。
