| 摘 要： | 休息权是自然人得以生存和发展的基本权利,属于基本人权的范围.同时,它也是自然人人格权必要的和基本的组成部分,是一项独立的人格权.在现代社会,休息权还是劳动者应当享有的与劳动权密切相关的一项基本权利.

| Abstract: | The right to rest is the basic right for existence and development of natural person which belongs to the scope of human rights.Meanwhile,it is also the essential part of personality rights of natural person as well as a right to an independent personality.Moreover,in modern society,the right to rest is a fundamental right of workers closely relate with the right to work. |
