区分所有建筑物的灾后重建

摘    要:区分所有建筑物的重建是灾后复兴的重要环节之一。区分所有建筑物全部灭失时,应依据《物权法》第97条决定是否予以重建;部分灭失时,可依据《物权法》第76条决定是否予以重建或修缮。抵押权原则上不及于重建后的房屋所有权,并应就部分灭失重建情形中的抵押权行使方式作出限制。数栋建筑物构成的住宅小区的灾后重建,原则上应由灭失或遭严重破坏的该栋建筑物的业主或原业主决定是否重建。在采用多数决决定是否重建时,应对反对重建的少数人的利益进行特别保护。因修改规划而导致当事人合法权益受损时,应依法对相关当事人予以合理补偿。
