法学视角下闲置土地的政府干预和市场化策略

针对法治背景下治理土地闲置的对策选择进行了探讨。运用解释论的研究方法，阐明增收城镇土地使用税或者收取土地闲置费，甚至开征土地闲置税乃至最终无偿收回土地使用权等无法根除土地闲置现象，且有违法理。结论认为，基于私法自治理论和市场对土地资源的优化配置功能，可通过延期开发、重组开发、移转开发和无偿收回土地等行政指导下的市场化策略区别应对闲置土地问题，为治理闲置土地提供规范模式。
