大学生受教育权与大学惩戒权的冲突与对策

近年来不断涌现的大学生诉高校不当处分案,反映了大学生受教育权与大学惩戒权的冲突正在加深。本文首先探讨了大学生受教育权和惩戒权的内涵,指出学生受教育权作为一项宪法权利的不可侵犯性和惩戒权作为大学自治手段存在的客观、合理性,其次分析了大学惩戒权与学生受教育权的法理冲突和现实冲突。最后提出了实现二者利益平衡,解决学生受教育权与惩戒权冲突的设想。

Countrmeasures for Contradictions between the Disciplinary Authority of University and the Students' Right to Education

Current cases in the disciplinary actions of universities are new problems calling for attention. It is necessary and urgent to research into the contradiction and equilibrium between the disciplinary authority of university and the students'right to education. Based on the current conflicts between them, this article inquires into the connotation of the right to education and the disciplinary authority of university and the rationality of it being a means of self-government. At the same time, the author points out the importance of the right to education as a constitutional right which can not be infringed. Finally, based on the analysis of the theoretical and realistic contradiction, the article presents the keys to the question.
