| 摘 要： | 商事审判调解是商事审判活动中的重要环节,影响商事审判调解效率的一个主要因素是调解过程中经常出现的"僵局",其与"胆小鬼博弈"理论的原始模型高度近似。如果法官能够将已经在商务谈判中广泛应用的"胆小鬼博弈"理论引入商事审判调解过程中,并在三个不同阶段扮演三种不同角色,将对解决"僵局"起到促进作用。

| Abstract: | The "deadlock" is a main factor influencing the efficiency of commercial trial mediation,which is an important step of commercial trial.The "deadlock" is also very similar to the original model of "Chicken Game" theory.If the judge can bring the "Chicken Game" theory that is already widely applied in commercial negotiation in the process of commercial trial mediation,and play three different roles in three different stages,it can be very helpful to solve the "deadlock". |
