| 摘 要： | 民间社会团体是结社自由权在社会实践层面的具体表征,也是实现国家与社会间良性互动的重要力量。但从现实层面来考察,当代中国民间社会团体的发展陷入了法治困境,集中表现为对其身份＂合法性＂的质疑。针对这一现状,我们必须在回应中国社会转型的基础上,对现有的社会团体立法体系及立法内容进行重新界定和解读。
