| 摘 要： | 现有关于法律移植的理论存在不可避免的局限,而以发展权为指导强调主体自主内源发展与外在借鉴相结合是探讨法律移植的新思维;以一种科学的比较法为内核的多元主义法律移植方法论是移植成功的关键。从强调外部性转向内外在条件的相互融合是法律移植的必由之路。
