司法公正与社会稳定问题研究

司法公正与维护社会稳定一直是最为普遍关注的一项课题,专家学者都从不同角度进行广泛、深入的探讨和研究。司法公正本身具有两个方面的含义,具体地说一是指司法机关对诉讼当事人作出的裁决或处理结果是公正的,二是指诉讼活动的过程对有关人员来说是公正的,或者说诉讼参与人在诉讼过程所受到的对待是公正的。从司法公正的含义、司法公正与社会稳定的关系以及如何实现司法公正等方面切入,以司法公正作为执政的一个重要环节和基础,作为社会发展的前题和途径,作为维护社会稳定的重要手段和最后的"关卡"为视角,对如何通过司法公正促进社会稳定进行了深入的探究。

A Study of Judicial Justice and Social Stability

Researches have been done on judicial justice and the preservation of social stability from different perspectives.Judicial justice has two senses.One refers to that the judgment or resolution made on the litigants is just,while the other means that the prosecution process is just to the parties concerned, or that the participants of prosecution are fairly treated in the prosecution process.This paper explores the approaches to social stability via judicial justice.It starts with the definition of judicial justice,the relationship between judicial justice and social stability and the way to realize judicial justice.It maintains that judicial justice is an integral part of governance,a premise to social development,and an important means or even the last "checkpoint" for the preservation of social stability.
