论法治与习俗--以社会行为为线索的一条社会学进路

鉴于人们在追求法治的进程中对道德与法律的过分关注,作者采用不同于法学研究的思路框架,以行为与秩序之间的调节介质作为视角,以社会行为作为分析线索,详细考察道德、法律、习俗这三种介质对行为与秩序的作用机理。指出:与道德和法律对于行为所起的条件刺激作用相比,习俗的重大意义常常被人遗忘。在某种程度上说,习俗为社会日常生活中的行为进行和秩序形成提供着“程序”。以此作为立论依据,进而揭示其对法治建设的积极意义。

On Nomocracy and Custom

In contrast to the fact that more and more attentions are paid to law and morality in the process of pursuing nomocracy, the author takes another perspective of medium between act and order (morality, law and custom) and takes social act as the clue of analyzing. The aim of this paper is to throw lights on the mechanism that media work between act and order. In comparison with morality and law, custom is more likely to be the procedure in which social act and order take place. Recognizing this is very important to achieving the goal of nomocracy.
