| 摘 要： | 电脑的广泛使用与网际网路的便捷，使得以电脑软体程式设计申请专利成为专利权人确保其权益的积极做法。对于保障电脑程式中的设计程序，除专利法外更可运用著作权法。探讨电脑软体程式与专利法暨电脑软体程式与著作权法的关联及软体使用契约与实务之间的运用，皆能提供以专利法或著作权法保障电脑软体的具体建议。

| Abstract: | Owing to the wide use of computers and the convenience of the lnternet, the patentee could apply for a pa tent on the compuler software programs to ensure his interest. Both patent and copyright protection share several common features amenable to software protection. Detailed suggestions on software protection through Patent Law or Copyright Law can be made under the discussion of the correlation of software with Patent Law and Copyright Law as well as the relation between software using contracts and practice. |
