| 摘 要： | 我国新旧刑法规定一般累犯构成的主观条件限制为故意犯罪,排斥过失犯罪,笔者认为,该规定与特别刑法相冲突,也存在着诸多明显的不合理性,建议立法机关适时取消新刑法第65条第一款的"但书"规定。

On Subjective Prerequisite for General Recidivism |

| Abstract: | The subjective prerequisite for general recidivism is confined to intentional offenses in both the old and the new Criminal Law of People's Republic of China, excluding the negligent commission of crimes. The author of this paper argues that the stipulation bears distinct irrationality as well as inconsistency with the specific spirit of the Lawitself. Thus it is suggested that the provision of "However" in Paragraph 1, Article 65 of the new Criminal Lawbe opportunely abolished by the legislature. |
