农村集体土地征收补偿立法构建研究——以《土地管理法》的修改为中心

土地征收公共利益的判断,应由立法机关、行政机关和司法机关共同来完成。 土地征收主体应限缩,应取消县、市级政府土地征收的审批权限,由省级政府负责土地征收审批。 行政机关做出征收决定前,应举办听证会,就土地征收是否符合“公共利益冶、征收必要性、征收补偿标准、征收范围、征收程序合法性等内容进行听证。 土地征收应根据公开市场上的交易价格作为补偿标准。 土地征收补偿应归农民集体所有,土地补偿费的使用、分配由本集体成员共同决定。

Research on Legislative Construction of Compensation for Rural Collective Land Expropriation

The judge of common interests in land expropriation should be completed by legislative body, administrative body and judicial body. The subject of land expropriation should be constricted. Concretely speaking, approval rights of land expropriation should be only entitled to provincial governments rather than county and municipal governments. Governments must conduct a hearing procedure before making a land expropriation decision, hearing the opinions of interested parties, including necessity and scope of expropriation, criterion of expropriation compensation, validity of expropriation procedure and whether the expropriation conforms to public interest and so on. Open market prices should be the criterion of land expropriation compensation. The compensation of land expropriation is owned by the peasant, so members of the group have rights to codetermine how to use and allocate the land compensation.
