最大真实：客观真实的否定之否定

作为上层建筑的司法制度必须与当前的经济基础即社会生产关系相适应,处于社会转型时期的司法制度应具有一定的弹性和包容性。客观真实过于理想化和抽象化,而与其对立的法律真实在复杂的社会现实面前又显示出"一刀切"即机械化和形式化的不足,最大真实吸取他们各自的合理成份,同时扬弃了双方的缺陷,从而达到了对客观真实的否定之否定,实现法律价值与社会效益的统一。

The Maximal Truth Theory--the Negation of the Negation of Objective Truth

The judical institution as a part of superstructure must be adaptive to the national situation and social conditions, so it should be flexible and compatible to some extent during the current stage of social transformation. The objective truth doctrine is excessively idealistic and abstract ,and the Legal truth doctrine which opposite to it tends to be mechanical and formalistic when dealing various of complicated situations with the same standards .The maximal truth doctrine proposed in this paper manages to take in the reasonable parts of the former two,and eliminates their disadvantages. Being the negation of the negation of Objective truth doctrine, the maximal truth theory achieves the unite of both social effect and law value.
