土地承包经营权若干法律问题思考

土地承包经营权是农民最为重要的权利之一,但其在立法指导思想上存有不足,该权利的稳定性和社员性问题皆由此产生。如此重要的一项权利,本应得到法律应有的重视,但事实上并未如此,特别是在该权利的征收补偿和继承方面,现有法律规定存在许多不足,不能起到切实保护农民利益的作用。

The right to contract and manage land is one of the important rights for the farmers,but the insufficiency of legal guiding ideology caused the problems of stability and membership.Such an important right should have been paid attention to,but in fact not,especially in the respects of compensation of the right and its inheritance and the current regulation has too much insufficiency which can not protect peasants' interest.
