试析公民自治与行政法治的良性互动发展关系

依法治国的核心是依法行政 ,要做到依法行政就必须处理好行政权与公民权这一核心关系。分析认为 ,要以公民自治促进行政法治 ,以行政法治保障公民自治 ,从而在多次博弈中实现两者的均衡发展。这种良性互动关系的形成 ,在我国从计划经济向市场经济的转型过程中 ,对促进社会主义法治国家的建立有着重要的意义。

The Benign Interaction and Mutual Promotion of Civil Autonomy and Rule by Administrative Law

The key to governing a country by law is to administrate by law. An analysis of the relationship between administrative power and civil rights shows that civil autonomy can promote the rule by administrative law and the latter can protect the former in the benign interaction and mutual development of these two. An equilibrium of development can be realized in games between them. It is held that the formation of such a benign interaction is of great significance in building China into a socialist country ruled by law during the period of social transformation from the planned economy to the market economy.
