| 摘 要： | 中国资本市场自上而下的监管体制导致资本市场呈现阶段性效率增进的特征，随着国内资本市场对外开放程度的不断提高和国际化进程的加快，需要资本市场灵活应对急剧变化的市场环境和要求，而只有在资本市场权利义务清晰定义的基础上，构建泛利性和创新性的资本市场监管体制才能实现资本市场效率的持续提高。
