| 摘 要： | 保安处分是西方国家针对犯罪率急剧上升之状况所采取的应对措施,是立法应对犯罪方式的积极变化。保安处分制度从诞生之日起就存在争论,在理论基础上存在学派之争、性质之争,并直接影响到刑事立法。

| Abstract: | Security Measures are the response measures taken for western countries after the sharp rise in crime,which is a positive change in ways of responding to crime.From the date of birth of Security Measures,there is controversy in the school based on the theoretic dispute,such as the dispute of school and nature,which directly affected the criminal legislation. |
