法律适应社会，而非社会适应法律——读《转变中的法律与社会：迈向回应型法》

伯克利学派在“法与社会”研究运动中，采用规范主义的研究范型，强调价值追求和经验研究相结合，关注社会现实，认为法律应当回应社会需求，进而获得相应变革和发展。在整合法律、政治和社会学的理论和方法的基础上，提出了法律三类型理论，构想并倡导一种回应型法。这给予我们一重要启示：是法律适应社会，而非社会适应法律。

Law should be Adapted to the Society Rather Than Vice Versa: A Review of Law and Society in Transition: Towards Responsive Law

In the campaign of "Law and Society" the Berkeley School adopts the norm-based research model, stresses the combination of value pursuit and experience studies, attaches importance to social reality, and holds that law should be responsive to social demands. These ideas underlie reform and development. The Berkeley School proposes the three-type legal theory, and construes and advocates a responsive way based on the integration of the theories and methods of law, politics and sociology. This paper assumes that the implication is that law should be adapted to the society rather than vice versa.
