我国《商标法》第15条的理解与适用

摘    要:我国《商标法》第15条对特定关系人(即代理人、代表人及其他特定关系人)商标抢注行为作了法律规制。在分析现有判例的基础上认为,已有在先申请或在先注册商标的情形下不应适用第15条;最终未形成代理关系或代表关系的情形下可适用第15条第1款;间接商务往来关系可根据双方的紧密度来判断属于代理关系、代表关系还是其他特定关系;在先使用中的“使用”应予放宽解释。在适用该法条时应坚持严格标准,以遏制违反诚信原则的行为,维护交易环境。

Abstract:Article 15 of the Trademark Law of our country embodies the legal regulation of the illegal act of trademark preemption by the specific related parties(i.e.agents,representatives and other specific related parties).Based on the analysis of existing cases,the results show that Article 15 should not be applied in the case of prior application or prior registration of trademarks,and Article 15,paragraph 1 can also be applied in the case of no agency or representative relationship.According to the closeness of both parties,the business relationship can be judged as agency,representatives or other specific relationship.The"use"in prior use should be interpreted loosely.In the application of this law,we should adhere to strict standards in order to effectively curb violations of the principle of good faith and maintain the purity of the trading environment.
