| 摘 要： | 计算机及其网络的普及大大提高了社会的文明程度，但与之相伴随的计算机犯罪也在一定程度上冲击着稳定的社会秩序。如何有效地规制计算机犯罪，已逐渐引起社会各界的关注。文章从计算机犯罪的概念着手，重点分析了计算机犯罪的特点，进而在剖析计算机犯罪构成要件的基础上评述了我国刑法中关于计算机犯罪的立法．并提出了部分建议。

| Abstract: | The wide use of computers and computer network has greatly enhanced the level of civilization, but computer crimes are, to a certain extent, threatening the stability of society and, therefore, how to effectively hold back computer crimes has at present become a problem of wide concern. This essay studies the concept and the special features of computer crime. Then, after analyzing the important components of the crime, it comments on the legal provisions concerning computer crimes in the criminal law of our country. A few suggestions are made as well. |
