| 摘 要： | 死者名誉的法律保护问题在理论界争议颇大,存在不同的说法。该文接受死者名誉的说法,并评述了其它说法的不足。同时,该文还论述了侵害死者名誉行为的构成要件以及侵害人应承担的法律责任,提出保护死者名誉应该注意的问题,并探讨了解决的方法。

| Abstract: | The problems of the fame of the dead cause many controversies on the theory circle,and it attracts different theories.This paper receives the theory of the fame of the dead,describes the weak point of other theories,and explains the composition of the encroaching behavior on the dead's reputation and the legal liability that the criminals should bear.Finally,the paper advances the problems that should be paid attention to in protecting the fame of the dead and discusses the methods. |
