论不连续背书持票人的权利

背书不连续存在于最初不连续、中间不连续和最后不连续。背书不连续也有实质不连续与形式不连续之分。形式不连续背书仅是持票人行使票据权利的障碍,不因此否认持票人的实质性权利。背书形式不连续而实质连续的持票人应可行使完整的票据权利;背书整体不连续但具有阶段性连续的持票人虽难以行使付款请求权,但鉴于付款请求权与追索权属于各自独立、性质相异的票据权利,持票人对于在连续中断后签名票据的背书人仍可享有追索权。
