我国劳动教养制度的合法性探讨

摘    要:劳动教养制度在中国社会曾经发挥过一定的历史作用,但由于涉及到限制公民人身自由长达四年之久,又不经过严格的侦察、起诉和审判等司法程序,与国家宪法和相关法律及国际人权公约的精神相冲突,因此显露出自身存在的问题和弊端。依法修改与完善极其必要,应当将劳动教养制度依法规范,使其与我国宪法和法律及国际公约相协调一致。

Abstract:The re-education through labor system used to play a historical role in China.But due to its restriction on citizens' freedom for almost four years without careful inspections,defects of this system are shown in the conflicts with the national constitution,related legal system and the international human rights treaty.Thus it is necessary to revise and improve the re-education through labor system in accordance with the judicial system,namely,it should coordinate with our national constitution,and other legal systems and international conventions.
