| 摘 要： | 法人类学与法史学有着很深的渊源关系，二者都重视对文化的研究，但是法人类学侧重于文化的横向比较，关注文化在具体社会中的功能与结构，是一种共时性问题的研究；法史学则从纵向来研究文化发展的过程，是一种历时性问题的研究。我国应构建以规则研究为中心，以法律民族志为方法，以文化反思为目的的法人类学。

| Abstract: | Legal anthropology and legal historiography are closely connected. Both of them attach importance to the study on culture. Legal anthropology places emphasis on cross culture comparison, focuses on the function and structure of culture in society from synchronic view, while legal historiography is a study on the development of culture from diaehronic view. Chinese legal anthropology construction should center on the study of rules and regulations, adopt the methods from legal ethnography, and take cultural reflection as its goal. |
