| 摘 要： | 从信任结构理论的角度看,传统中国是一个人格信任的社会,由此决定了适用于其中的法律的伦理化品性.只有对这些特点有了明确的把握以后,在中国社会与法律的现代化转型中,我们才能获得更为明晰的前进方向和出路:建立系统信任为主导的社会结构和形式化的法律制度.

| Abstract: | Traditional china is a personality-credit society from the theory of structure of credit.Legal ethical character in this society was decided by this feature.Only when we recognize this character,we can gain more distinct way in modern transformation of Chinese society and law: to establish social structure guided by systematic credit and formal legal system. |
