| 摘 要： | 社会自由秩序由心态自由秩序与法律自由秩序共同构成,审美道德论构建的是心态自由秩序,政治正义构建的是法律自由秩序,两者缺一不可。在中国文化中,人们过于重视心态自由秩序的建立,并将审美道德论的作用进行了不适当的夸大;在现代化进程中,我们必须重视法律自由秩序的建立,或者说,法律自由秩序必须优先于心态自由秩序的建立。基于此,才能构建社会的真正和谐。

| Abstract: | Social free order consists of mental free order and legal free order; the former is constructed by aesthetic morality theory, while the latter, by political justice. Yet both cannot separate from each other. In Chinese culture, the establishment of mental free order has been paid too much attention to, and the function of aesthetic morality theory has been overstated. Therefore, we must attach greater importance to the establishment of legal free order, that is, legal free order must has priority over menal free order in the course of modernization drive. In this way, we can build a really harmonious society. |
