互联网环境下劳动关系的认定——基于区域比较的路径

摘    要:在当今以网络为主导的社会中,我国相继出现了大量新兴行业领域。劳动关系作为最基本的社会法律关系之一,受到了互联网快速发展的冲击,导致传统劳动关系认定理论的动摇。为适应互联网用工的特点,我们必须对劳动关系的认定做出适应性变革。结合各个国家、地区的认定标准,认定互联网用工中劳动关系应根据不同单位特性以及不同类型工人的实际用工性质,在以核心判定标准即“从属性”为前提的基础上,综合考虑个案事实,以更加灵活的要求进行具体分析。我国传统劳动关系的认定标准表现出“僵化”“指向混乱”“涵义不明”等显著缺陷,以一种非泛化的标准去把握互联网环境下劳动关系认定的实质内容,将是未来法律完善的关键导向。

Identification of Labor Relations in the Internet Environment--Paths Based on Regional Comparison

Abstract:In today’s network-dominated society,a large number of new industries have emerged.Labor relations,as one of the most basic social and legal relations,have also been impacted by the rapid development of the internet,which has led to the vacillation of the traditional labor relations identification theory.Therefore,in order to adapt to the characteristics of internet employment,the identification of labor relations urgently requires adaptive changes.In view of the standards of various countries and regions,we should identify the labor relations in internet employment based on the characteristics of different units,the actual employment characteristics of different types of workers,the core determination criteria of the“subordinate attributes”.We should analyze the facts of the case flexibly.The identification standards of traditional labor relations in China show significant defects such as“rigidity”,“confusion of orientation”and“ambiguity of meaning”.Establishing a non-generalized standard to grasp the essence of labor relations identification in the internet environment will be the key guide for the improvement of the law in the future.
