摘 要: | 随着技术进步,新型的劳动用工模式引发了劳动关系界定上的难题,特别是在以灵活就业模式为典型代表的网约车领域。当下网约车行业主要有C2C和B2C两种模式,由于网约车行业劳动关系的认定存在难题,且这两种不同经营模式存在一定的差异,因此产生了网约车从业者合法利益保障不足的难题。对此,基于当下网约车公司的主要经营模式以及法律规制现状,可以从经济从属性与现行管理体制两方面出发,对当下网约车行业中存在的问题进行分析解决,从而更好地保护网约车从业人员的正当权益。

Abstract: | With the development of technology,the new mode of employment has caused the difficulty in defining labor relations,especially in the field of online ride-hailing,which is typically represented by the flexible employment mode.When the online ride-hailing industry is mainly divided into C2C and B2C modes,problems exist in the identification of labor relations in the online ride-hailing industry,and there are some differences between the two business models,resulting in the problems of insufficient protection of legal interests of online ride-hailing practitioners.In this regard,based on the main business model and legal regulation status of local ride-hailing companies,problems existing in local ride-hailing industry can be analyzed and solved from two aspects of economic attributes and current management system so as to better protect the legitimate interests of local ride-hailing employees. |
