| 摘 要： | 《公民权利和政治权利国际公约》第27条以及人权事务委员会据此所处理的个人来文是国际法上少数人权利保护的最重要的渊源,也对我国少数民族的人权保护尤其是文化权利的保护产生积极的影响。从"卢比康湖部落诉加拿大案"的分析中可知,少数人(民族)保持其传统生活方式的权利是其文化权利的核心。对少数民族传统生活方式的保护是我国保持文化多样性的重中之重,完善与此相关的法律是我们迫切需要解决的难题。

| Abstract: | Article 27 of Optional Protocol to the Covenant on Civil and Political Rights and the cases delt according to the Optional Protocol to the Covenant on Civil and Political Rights were the few expressions of protecting minority human rights in the international laws.It has the active influence on the protecting of human right,especially the cultural right of the ethnic minority groups.From this case we can see that the core cultural right of ethnic minority groups is maintaining their traditional living model.Protecting the living model of ethnic minority groups should be the top priority of protecting cultural diversity.The key issue is to make out relative laws. |
