保障性住房建设的政策演进及其法律保障

保障性住房建设本身并不是进行房价调控的手段，而是满足国民基本住房权利的内在需要。住房改革以来关于房地产调控的宏观政策中对保障性住房建设缺乏统一的政策体系和系统的法律支持，导致保障性住房建设不能发挥相应的社会作用。国家应从完善基本立法的角度，以法律形式明确建管制度、基础住房信息数据库、建设模式和预期管理等问题，将保障房建设引入规范化、法治化的轨道。

Evolution of Indemnificatory Housing Policies and Its Legislative Security

It is not a controlling way to adjust the price of real estate to construct indemnificatory housing,but a way to meet the basic housing demand of national people.Looking back on the macro-controlling policies of real estate since housing reform in China,the author finds that the unified policy system and systematic legislations support are still missing,which make that the indemnificatory housing could not play its function.Therefore,the author put forwards that government should guide the indemnificatory housing construction on a standardized and legislative track by solving these problems with law,such as constructing and administrating system,information database of basic housing,constructing mode and anticipated management,and so on.
