科学技术发展对我国法律的挑战及其对策

以信息技术和生物技术为例,从微观和实证的角度研究了科学技术发展带来的诸多法律问题,主要有:信息获取与信息传播技术发展带来的法律问题、虚拟空间中的法律问题、电子商务带来的法律问题、信息技术发展带来的知识产权保护问题、生物技术研究本身对法律的挑战、对民法的挑战、对我国生物及遗传资源的保护.通过分析这些微观的问题得出了他们的共性并给出了相应对策:科学技术发展产生了新的社会关系需要法律予以调整;科学技术的发展使得我们对原有的社会关系的认识发生了改变而需要法律进行相应的改变;科学技术的发展使某些既有的社会关系发生了改变需要调整既有法律;科学技术的发展使既有的社会关系产生了新的形式;科学技术的发展带来的在现阶段无法确认的问题有待科学技术自身发展去解决.

Challenge to China Legal System by the Development of Science and Technology and Its Countermeasures

The empirical research on legal problems brought by the development of science and technology is done,and information technology and biotechnology are taken as examples. The following legal problems are studied, such as legal problems brought with information achieving and spreading technologies' development, legal problems brought with the studying process of biotechnology, the challenge to civil law with the development of science and technology, the protection of biological and genetic resource in China. The countermeasures are proposed by analyzing them. First, the development of science and technology brings new social relation which need to be regulated by law. Second,the development also changes our cognition of old social relation,then we should amend the law.Third, the development science and technology changes the old social relation,which also requires the law to be amended.The fourth,it brings new representation types of old social relation. Finally, we propose that some problems can not be solved now, and the development itself will solve them.
