| Abstract: | In terms of such human nature as ＂for gains against losses＂, there is a profound connotation in the legal thoughts indicating ＂the Ethic Nature＂. The modernity of the democratic legal construction requires the modernized legal mind to provide the cornerstone systematically for the legal construction in a harmonious society, and the criticism of the inner refutations in the traditional legal system. |
