意大利刑事司法改革实践对我国的借鉴意义——以法律移植与本土化为视角

借鉴和引进域外的法律制度是我国司法改革的基本方式。意大利刑事司法制度改革试图将两大诉讼模式混合,与我国1996年进行的庭审方式改革很相似。由于我们两国刑事诉讼改革中存在相似之处,意大利司法改革实践的利弊得失情况对我国刑事司法改革有重要借鉴意义。文章通过对意大利刑事司法改革的实施效果及原因进行分析,强调借鉴其利弊得失来准确把握我国法律移植的阶段性和前瞻性。

The Reference Significance of Italy's Reform Practice in Criminal Justice for China--in the View of Legal Transplant and Localization

New measures in China' s justice reform have kept appearing.The basic method is to introduce and use the foreign laws for reference.Italy' s system reform in criminal justice tries to combine the two major lawsuit modes,which is quite similar to our court hearing reform in 1996.Because of the similarities in the criminal lawsuit reform between China and Italy,the advantages and disadvantages of Italy' s reform are of important reference significance for our criminal justice reform.This paper makes an analysis of the effect and causes of Italy' s criminal justice reform and draws lessons from its advantages and disadvantages in order to accurately grasp the stages and future of our legal transplant.
