论法官惩戒之事由

英美法系国家或大陆法系国家的法官惩戒事由主要包括司法内不当行为和司法外不当行为两个部分,而我国司法实践中,法官惩戒事由除上述两个方面的内容外,还包括＂错案追究＂和＂业绩考核＂。为完善我国法官惩戒制度,未来应当在逐渐扩大司法外不当行为的范围、为法官惩戒设置禁区、消除业绩考核和错案追究制度给法官带来的消极影响等几个方面努力,使法官惩戒逐渐从＂行为、结果混合主义＂转向＂行为主义＂。

On the Judge Disciplinary Subjects

In both the common law countries and civil law countries,judge disciplinary subjects generally include the judicial misconducts and non-judicial misconducts.While in Chinese judicial practice,besides the before-mentioned two kinds of acts,＂responsibility for misjudged cases＂ and ＂performance evaluation＂ are also included.In order to improve China＇s current judge disciplinary system,efforts should be made from following aspects,such as gradually expanding the scope of the judicial misconducts,setting up prohibited areas for punishment,and eliminating the negative impacts of performance evaluation and the system of affixing responsibility for misjudged cases on the judges,etc.So the transformation from ＂act and result-centered＂punitive approach to＂act-centered＂ punitive approach can be achieved.
