| 摘 要： | 从埃利希提出"活法"概念直至当代的法律多元理论,从与自然法学派、分析法学派有关理论的对比中,可以看出活法理论的形成理路、鲜明特点和在当今的强势发展.此外,针对国内学者围绕活法理论和法治建设道路的有关争论,文章指出了活法理论的多重影响和意义.

| Abstract: | Based on Erich's expostulation of living law, the pluralism of contemporary laws, and a comparative study of natural law and analytical law, the paper reveals the formation, characteristics and current development of the living law, concluding that the discussion now prevalent in China concerning the concept and practice of the living law is of great significance both theoretically and practically. |
