论知识产权滥用及其法律规制

权利的行使必须遵循一般的法律原则 ,知识产权的行使也不例外 ,否则就构成知识产权滥用。在明确知识产权滥用的概念、成立标准及表现形式的基础上 ,笔者对知识产权滥用的法律规制提出一些立法和执法方面的建议 ,希望在相关法律中平衡地规制知识产权的保护和知识产权的正确行使 ,以更加有效地促进我国科学技术的健康蓬勃发展

The Abuse of Intellectual Property and Relevant Regulations of law

The exercise of right must follow the common lawful principles ,or it will be abuse of right ,the exercise of Intellectual Property(IP) too. On the base of discussing the concept ,the statutory standards and the forms of expression of the abuse of IP ,the author offers some suggestions about the regulation of exercise of the 1P by law. The author considers unless the protection of the IP and the exercise of the IP be regulated on balance in the law ,the science and technology can develop healthfully and vigorously.
