征地补偿标准与失地农民的利益保护

本文利用净现值估价理论,为我国征地补偿标准的确定设计了一个估算模型,认为依据土地年产值的一定倍数估算征地补偿是科学的,但补偿倍数应根据土地的投入产出比、年产值增长率和失地农民使用征地补偿款能够获得的年收益率等指标进行测算。运用近9年实际资料估算,我国征地补偿标准应为土地年产值的24.28倍左右,现行"30倍"的最低补偿标准对失地农民的利益保护总体上是充分的。当前,失地农民实际补偿不足的根源,一是法定最低补偿标准没有得到执行,二是征地补偿款被乡村截留,分配不合理。维护失地农民的利益关键在于严格征地补偿估算方法,理顺征地补偿款的分配,使法定的征地补偿能真正足额地落到失地农民的手中。

Compensation Standard of Farmland Requisition and Farmers' Benefits Guarantee

Based on the net present value model,a model of estimating compensation standard of farmland requisition has been set up in this paper.The results showed that the compensation could be properly calculated by a multiple of the farmland's yearly product value,but the compensation multiple should be measured by the farmland's input-output ratio,yearly product value increasing rate,and the yield rate of farmers dealing with the compensation fund.Using the recent 9 years data,this paper estimated that the compensation standard should be 24.28 times of the farmland's yearly product value in China,which means that "30 times" compensation multiple regulated by law is sufficient in protecting farmers' benefits.Practically,the reason of compensation deficiency is that the compensation standard regulated by law has not been executed and the compensation fund is distributed irrationally.
