| 摘 要： | 中国宪法作为国家根本大法的地位早已确立,但迄今为止,宪法所具有的“最高法律效力”并未在司法程序中得以实现,司法机关的违宪审查权也未予确立,这与法治和宪政的要求相去甚远。针对此,文章通过揭示宪法实施中的现存障碍,提出了实现我国宪法的司法适用及违宪审查的合理架构。
