| 摘 要： | 民间是个主体性概念.民间立场就是学者在法社会学研究中,倾向于从普通民众的角度来提出问题、观察问题、思考问题和解决问题,它是相对于传统法学所采取的自上而下的官方立场而言的.法社会学采取民间立场,意味着研究者应该关注、尊重并尽量满足民间的需求、意愿、情感和态度;意味着法社会学思维走向的转变和法律接受问题的凸显;意味着法是多元的,要重视和研究多元法之间的互动关系;还意味着纠纷解决和法律秩序的生成与重组应该成为法社会学的核心问题.

| Abstract: | The folk community is a subjective concept. Taking the folk position means that researchers of sociology of law put forward,observe,consider and solve problems from the standpoint of folks. It is in sharp contrast with the superincumbent official position in traditional jurisprudence. Taking the folk position of sociology of law implies that researchers should be concerned about,respect the demands,wishes,feelings and attitudes of the folk community.
