| 摘 要： | 在UNFCCC及《京都议定书》的框架下,促进包括清洁能源技术在内的国际转让,是《哥本哈根协议》之后的气候变化谈判的主要议题之一。由于我国在清洁能源技术领域的研发与运用起步较晚,因此,在继续积极引进外国先进技术的同时,应加大自主研发力度。鉴于目前尚缺少有拘束力的国际技术转让协定,我国在后《京都议定书》时期,应根据国际惯例和国情,规制反竞争的专利许可做法;区分专利侵权与合理利用,保障专利技术的转让后续研发;制定太阳能和风能技术标准和相关专利许可规定;适当强制许可使用涉及重大公共利益的清洁能源技术专利;大力推进CDM项目开发,促进发达国家在我国转让清洁能源技术。
