| 摘 要： | 阐述了法官裁量权的必然性和标准,分析了法官裁量权在建设法治国家过程中的作用,指出法官理智而合理地行使裁量权,能够促进我国法律体系的完善,能够增强人们的法治观念,能够促进法治秩序的建立,最终积极促进社会主义法治国家的建立,实现中国人的法治国理想。

| Abstract: | This article illustrates the necessity and standard of judicial discretionary power,analyzes the role of judicial discretionary power in the process of building a country ruled by law.Then the article points out that if judicial discretionary power is exercised rationally,it can impel the perfection of our legal system,enforce citizens' legal conviction,and enhance legal order.Finally it will impel the building of a country ruled by law and realize Chinese people's dream of a country ruled by law. |
