| 摘 要： | 实践中,预告登记在强制执行程序中存在能否排除执行、查封后能否进行本登记、经预告登记的抵押权能否优先受偿、预查封后能否解除合同等问题。可将预告登记按权利种类分为所有权、抵押权、用益物权、房屋租赁权的预告登记,并分别阐述其在执行程序中所具有的不同效力。
