| 摘 要： | 原产地名称权是一项重要知识产权 ,我国有关立法和理论研究却是一个薄弱环节。本文揭示了原产地名称的内涵及其智力成果属性 ,比较分析了Trips协议等知识产权国际条约的相关规定和外国对原产地名称的立法保护模式 ,提出了颁布原产地名称保护特别法和健全管理体制等完善我国原产地名称保护法律制度的建设性意见。

| Abstract: | Appellations of origin is an important intellectual property, but the legislation and theoretical research of this issue is a weak point in China. This paper reveals its connotation and intelligence property attribute, compares and analyses the relevant stipulations of international treaties such as Trips and the legislative models in foreign countries. That apart, it puts forward some suggestions on how to improve legal protection system of appellations of origin in China. |
