| 摘 要： | 基于法律效力层次的理论和我国法律的相关规定,分析海上人身伤亡损害赔偿责任限制所应适用的法律,并得出《海商法》实施后,最高人民法院司法解释中规定的海上人身伤亡最高赔偿限额不应再适用的结论。

| Abstract: | Based upon the principle of priority of legal statutes and their related provisions, discusses the application of law to the matters regarding limitation of liability for loss of life or personal injury at sea and concludes that the provisions of maximum amount of compensation for such loss or injury contained in the judicial interpretation by the Supreme People's Court should not be applicable anymore after the coming into force of China Maritime Code. |
