| 摘 要： | 沉默权作为一项刑事诉讼法律制度,其合理性得到了国际上的普遍确认,但在我国至今尚未确立,现实的发展需要我们对沉默权进行移植.在法律移植的过程中要注意同本国国情相适应,建立起一套保障制度,并及时消除其负面影响,从而使沉默权趋于完善.

| Abstract: | The right to silence is an important institution of criminal proceedings system.It has been recognized by the majority of countries because of its ration,but China has't established the right to silence as the criminal proceedings law.Nowadays,development needs transplanting the right to silence.In the process of transplantation,it should be fit for the native conditions,and we should set up guarantee institution,and eliminate its negative influence to perfect the right to silence. |
