构建权责统一的法治政府——质疑"'权力政府'向'责任政府'转变"观

政府权力与责任是相辅相成的,提出“权力政府”向“责任政府”转变的观点,人为地割断权责之间的联系,臆造两种类型的政府,从法理、管理和哲理各种角度分析,都很难自圆其说,也与政府行政组织的原则相左,不符合行政组织的性质、执法体制和依法行政的要求。只有改革我国过分集权的领导体制,促使政府政治化权力转为法治化权力,才能从根本上增强政府的责任心。

Construction of a rule-by-law government with power and responsibility well-balanced: a study based on some query into the idea of shifting the "power-focused government" towards a "responsibility-focused givernment"

Power and responsibility of the government are complimentary.The proposal of shifting a "power-focused government" towards a "responsibility-focused government",which is to cut power off responsibility and crop up two kinds of government,is in lack of support from the perspectives of law,administration and philosophy.The idea is also against the principle of the government administrative organization,not in conformity with the nature of administrative organization,the law enforcement system,or the needs of law-based administration.It is believed that the only way to increase the government's awareness of responsibility is to reform the over-concentration of power of the government and to shift the political power towards legal power.
