农村改革与集体所有权的完善

回顾农村改革30年的发展,值得反思的问题是,如何对待集体的统一经营,如何协调集体所有权与承包经营权的关系,如何依据集体所有权的特性加强集体所有权的制度建设.其基本结论是:集体的统一经营模式也是集体所有权实现的有效形式,应当赋予其应有的法律地位;应当公平合理地规范集体所有权与承包经营权的关系,在规定承包经营权对集体所有权的定限作用时,应当适当强化集体所有权;应当依据集体所有权的公有性质加强集体所有权的制度建设,解决集体成员集体所有与成员在集体所有权中的利益实现问题.
