跨国环境侵权法律适用初探

跨国环境侵权事件不断发生,不仅给发生污染事故的本国及国民,也给他国境内的生命财产造成严重损害或损害威胁,为此各国都加强了对跨国环境侵权问题的研究及相关立法与司法实践的完善。尽管如此,与跨国环境侵权发展的实际情况相比,相关的国际和国内法却仍然很不完善。只有少数的国际法文件和国内立法规定了相关的特殊冲突规则,其余都直接用一般的冲突规则来解决此类问题。我国的相关立法现状体现了我国立法的先进性,但仍需进一步完善。
