| 摘 要： | 小区停车位的产权归属,一直是开发商和业主的争议焦点。《中华人民共和国物权法》第七十四条将约定方式作为判断车位车库归属的依据,但是由于其理解上的困惑,仍然存在着发生纠纷的隐患。本文从楼房出卖前和楼房出卖后两个阶段来探讨小区停车位的产权归属,并提出了相关立法完善建议。

| Abstract: | The proprietorship of parking lots in residence has been a focus of argument between housing developers and residents.Clause 74 of Property Rights Law determines the proprietorship of parking lots and garages according to arrangement.Nevertheless,confusion and conflicts would arise.This paper studies the proprietorship of parking lots from the pre-sale and post-sale stages and proposes ways for improvement. |
